Nutopia Greenhouses – Terms & Conditions

By accepting a quotation or purchasing products or services from Nutopia Greenhouses (“Nutopia”), the customer agrees to the following Terms & Conditions.

1. Product Variations

Our greenhouses are manufactured in New Zealand in small production runs using quality timber and building materials. Unlike mass-produced products, each greenhouse is individually prepared from natural materials, meaning every structure will have its own unique character.

Most timber components are supplied pre-cut to length to simplify installation, with garden beds, benches and other timber components pre-manufactured where applicable. Due to normal manufacturing tolerances and varying site conditions, a small number of components may require trimming or minor cutting during installation to achieve the best fit. This is a normal part of the installation process and does not indicate that parts have been incorrectly supplied.

Product photographs, brochures and website images are intended as a guide only. Colours, timber grain, stain finish and overall appearance may vary from those shown.

Minor rubbing, scuffs, pressure marks or compression marks caused during manufacturing, packing, transport or installation are considered normal and are not defects.

Timber stain colours may vary between batches and individual timber pieces due to natural differences in timber grain and absorption. This is normal and contributes to the character of each greenhouse.

Unless otherwise stated, all dimensions are nominal only and normal construction tolerances apply.

 


 

2. Natural Timber

Timber is a natural product and may contain knots, grain variation, colour variation, resin, checking (small surface cracks), shrinkage, expansion and seasonal movement.

These are natural characteristics of timber and are not considered defects provided they do not affect the structural integrity or intended performance of the greenhouse.

Our greenhouse design intentionally leaves the structural timber framing visible through the polycarbonate cladding. Unlike most buildings where framing is concealed behind wall linings, the framing forms part of the finished appearance of the greenhouse.

While every effort is made to produce a neat and consistent finish, natural timber will always vary in appearance. A perfectly uniform or furniture-grade finish is neither possible nor intended for an exposed structural timber building.

Minor surface checking, small splits, resin bleed and other natural timber characteristics are expected and are not considered defects unless they compromise the structural integrity of the component.

 


 

3. Delivery

Please inspect all goods immediately upon delivery.

Any visible freight damage should be reported to Nutopia as soon as possible with photographs where practical.

For all kitsets, a materials list will be supplied with your delivery. The customer is responsible for checking that all materials have been received and inspecting them for any damage.

Any shortages, incorrect items or damage must be reported to us within seven (7) days of delivery. If we are not notified within this timeframe, the materials supplied will be deemed to have been received complete and in good condition.

If the Kitset Build is not going to happen right away, the customer is responsible for storing all materials safely and protecting them from sun, weather and damage.

 


 

4. Site Requirements

Installation quotations are based on a reasonably level site with good access.

Prior to installation we may request photographs of the proposed site and recommend the greenhouse location be marked or pegged to assist with planning.

If the site is sloping or uneven, available options may include:

  • Site preparation by the customer or their contractor.
  • An optional raised floor system (arranged before installation).
  • Temporary levelling using packers or blocks where appropriate.

Temporary levelling methods may result in small gaps beneath parts of the structure and are not considered defects.

Unexpected site conditions, excessive levelling, difficult access or unforeseen obstacles that increase installation time may incur additional labour charges.

Please advise us before installation of any restricted access, including narrow gateways, steep driveways, soft ground or any other conditions that may affect installation.

The customer is responsible for:

  • Providing a clear, safe and accessible work area.
  • Ensuring the site is suitable for installation.
  • Locating underground services.
  • Obtaining any required building or resource consents.
  • Providing foundations or concrete slabs to the agreed dimensions unless otherwise included in the quotation.

Our installers are greenhouse installers, not earthworks contractors. Site preparation is the responsibility of the customer unless specifically included in the quotation.

Important: Our installation quotations are based on a reasonably level site with good access, using the information available at the time of quoting. If unexpected site conditions, restricted access, inaccurate site information or customer-requested changes are encountered on the day that require additional time, labour, materials or equipment, additional charges may apply. Where practicable, we will discuss any additional costs with you before proceeding.

Weather, freight delays and circumstances beyond our control may occasionally delay delivery or installation.

 


 

5. Installation/Assembly

Where Nutopia arranges installation, we use experienced independent installers who are familiar with our products and installation methods. We provide installation drawings, guidance and ongoing support to help achieve a high standard of workmanship.

As every greenhouse is assembled on site by independent installers using natural timber, some variation in workmanship and finishing is inevitable. Each installer has their own techniques and methods, and while we expect a high standard of workmanship, identical cosmetic finishes cannot be guaranteed.

Because the timber framework remains visible through the polycarbonate cladding, the framing itself forms part of the appearance of the finished greenhouse. Our installers take care to achieve a neat and tidy finish; however, minor variations in timber alignment, fixing positions, joints and finishing are normal and are not considered defects.

Minor cosmetic imperfections including nail or screw placement, slight timber movement, small gaps, checking, resin bleed and natural timber characteristics do not affect the structural integrity or intended performance of the greenhouse.

Nutopia coordinates the installation process but cannot guarantee identical workmanship between installers. Our responsibility is to ensure the greenhouse is structurally sound, safe, durable and fit for its intended purpose.

Where an issue affects structural integrity, weather resistance, safe operation or intended function, we will work with the installer to ensure it is rectified.

Installation does not include cosmetic perfection. In many cases, attempting to remove very minor visual imperfections can require unnecessary alterations or additional fixings that may further affect the appearance of the timber. For this reason, remedial work will generally only be undertaken where it is considered reasonable and necessary.

Any concerns relating to installation should be reported to Nutopia within seven (7) days of practical completion, together with photographs where appropriate.

Any work requested outside the original quotation, or changes requested once installation has commenced, may incur additional charges.

For kitset purchases, temporary timber bracing required during assembly is the responsibility of the customer unless otherwise stated. Temporary bracing timber is not supplied with the kit.

 


 

6. Payment Terms

A 30% deposit is required before manufacture or scheduling of installation.

Unless otherwise agreed in writing:

  • Kitset orders must be paid in full prior to dispatch.
  • Installed greenhouses must be paid in full on the day of practical completion.

Late payment may delay manufacture, delivery or installation.

Payments made by Visa, Mastercard or debit card incur a 3% processing surcharge.

 


 

7. Consumer Guarantees Act

Nothing in these Terms & Conditions limits the rights of consumers under the Consumer Guarantees Act 1993 or any other applicable New Zealand legislation.

 


 

8. Limitation of Liability

To the maximum extent permitted by law, Nutopia Greenhouses shall not be liable for indirect, incidental or consequential loss arising from the purchase, installation or use of our products.

Nutopia’s total liability shall not exceed the value of the products or services supplied.

 


 

9. Privacy

Customer information is collected solely for processing orders, providing customer service and meeting our legal obligations. Personal information will not be sold or disclosed except where necessary to complete your order or where required by law.

 


 

10. Cancellation

Orders cancelled after manufacture has commenced or materials have been ordered may incur administration, manufacturing or restocking charges.

Deposits may be non-refundable where costs have already been incurred.

Specifications, pricing and product details may change without notice as we continually improve our products.
